Mike Dortch is a civil trial lawyer with extensive
experience litigating cases involving commercial, contract,
and probate issues, environmental and energy law, real
property rights, and the regulation of the
telecommunications industry. A partial list of the matters
of public record for which Mike has been responsible is
available under the "Notable Cases" section of this website.
In the environmental field, Mike has represented numerous
clients concerning CERCLA cost recovery actions, site
remediation activities, and emergency response. He
successfully opposed an EPA-proposed rule that would have
listed real property owned by clients on the National
Priorities List. He successfully defended the executor of an
estate against claims that the executor had both CERCLA
liability and fiduciary obligations requiring it to
undertake the remediation of contaminated property belonging
to the deceased. The editors of Cincinnati Magazine,
in conjunction with Law and Politics Media, Inc.,
named Mike an "Ohio Super Lawyer" in the category of
Environmental/Land Use law.
In his energy practice, Mike represented one of Ohio’s
investor owned utilities during the restructuring of the
electric industry in Ohio. He later represented the same
client in proceedings to obtain PUCO approval of its merger
with another investor owned utility. Mike has also
represented rural electric cooperatives, a fully-integrated
Ohio based energy services company, and natural gas local
distribution companies. Mike has represented several
companies before the Ohio Power Siting Board in connection
with their efforts to construct electric power generation
plants in Ohio. Mike also advises commercial and industrial
clients regarding their electric and natural gas services
contracts.
Mike has represented telecommunications service providers
(CLECs, IXCs, cellular, paging, mobile radio) in all manner
of cases before the PUCO since 1990. In addition, he advises
developers and other large consumers of telecommunications
services regarding their telecommunications issues.
Mike is admitted to practice before all Ohio courts by
the Ohio Supreme Court and by the United States Court of
Appeals for the Sixth Circuit, the United States District
Court for the Southern District of Ohio, and the United
States District Court for the Northern District of Ohio.
Mike graduated summa cum laude from Capital University
Law School, where he authored a Comment published in the
Capital University Law Review, Due Process and Punitive
Damages: Does the Constitution Require Definitions of
Degrees of Culpability? 18 Cap. U. L. Rev. 565. His
comment later served as the basis for arguments presented to
the United States Supreme Court.
Mike is a member of the American Bar Association, the
Ohio State Bar Association, the Columbus Bar Association and
the Federal Bar Association.
