Mike Dortch wins dismissal of all counts raised against Kravitz Brown & Dortch, LLC's client, Cytek, Ltd. Cytek, Ltd. operates an adult social networking site. Cytek and numerous others were sued by the psuedonominal "John Doe" after Mr. Doe was arrested and indicted for having sexual intercourse with a fourteen year old. Mr. Doe claimed that the operator of the web site and other entities associated with the site owed him a duty to ensure that only those over eighteen years of age had access to the website. The Court, however, held that the Communications Decency Act, 47 U.S.C. Section 230, immunizes operators of online adult dating services, as a mere web host, from liability arising out of a user’s false statement in her user profile. Doe v. Sexsearch et al., 502 F. Supp. 2d 719 (N.D. Ohio). Mike worked with co-counsel from Los Angeles, Detroit, Cleveland and Toledo to obtain the complete vindication of all defendants sued by Mr. Doe.
